1. Acceptance of Terms

By accessing or using Bracket Banter ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Bracket Banter is a social bracket competition platform that allows users to create tournament brackets, invite participants, make picks, and engage in friendly banter. The Service includes AI-powered commentary features.

3. Account Registration

To use certain features of the Service, you must register for an account by providing a valid phone number. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. SMS Communications

By registering for an account, you consent to receive transactional SMS messages from Bracket Banter, including one-time verification codes for authentication purposes. Message and data rates may apply.

You may separately opt in to receive promotional SMS messages, including tournament reminders and updates. This consent is optional and not required to use the Service. You may opt out of promotional messages at any time by replying STOP to any message or updating your notification preferences in your account settings.

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or threaten other users
• Impersonate another person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service
• Post content that is offensive, hateful, or violates the rights of others

6. Content

You retain ownership of content you create on the Service (such as banter posts and bracket picks). By posting content, you grant Bracket Banter a non-exclusive, worldwide license to use, display, and distribute that content within the Service.

7. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in conduct that we determine is harmful to other users or the Service. Users who are banned may submit an appeal through the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Bracket Banter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes. Your continued use of the Service after changes constitutes acceptance of the updated terms. These Terms of Service are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.
